While the Local Government Act requires meetings of Council or any of its committees to be open to the public, from time to time some matters need to be discussed in confidence, and confidential matters are covered by Sections 90 and 91 of the Act.
Council does not have the authority to classify an issue as confidential. Instead, confidential matters are defined by the Local Government Act 1999 (Section 90 and 91) and include, but are not limited to commercial-in-confidence, security matters, staff matters, legal advice/litigation or the personal affairs of people living or dead.
