Background

On the 22 April 2021, the Minister for Planning and Local Government approved a proposal to initiate a Code Amendment over the site. The Code Amendment seeks to change the zoning of the site from Suburban Business Zone and Established Neighbourhood Zone to the Urban Corridor (Business) Zone. Under the proposed Zone, a future proposal could accommodate a mixed use development of up to seven building levels. The Affected Area is approximately 7,300 square metres in size and contains the Scotty’s Motel, two detached dwellings and vacant land.

Section 73 of the Planning, Development and Infrastructure Act 2016 stipulates that an applicant can apply for an amendment to the Planning and Design Code directly to the Minister for Planning and Local Government, bypassing Council. In this instance, the proponent of the Scotty's Corner site – YS Super Investments Pty Ltd c/- Future Urban Group – has chosen this pathway. Therefore, Council has not been involved within this process and has not seen the final Code Amendment package.

It is Council’s intention to have the Code Amendment documentation independently reviewed by a private planning consultant and to present this formally at a Council Meeting, along with a draft submission, prior to the end of the consultation period. Subject to the endorsement of Council, a submission will then be made to YS Super Investments Pty Ltd care of Future Urban Group, which is undertaking the Code Amendment process.

Council encourages any members of the community who are concerned with the introduction of this Code Amendment, to submit their planning concerns in writing to Future Urban Group during the official consultation period.

Future Urban Group undertook a previous public consultation from 9am Monday 9 August 2021 to 5pm Sunday 19 September 2021.

Council submission

The Town of Walkerville made a submission to Future Urban Group on Friday 17 September 2021.
